Content standards for submissions

  • Be genuinely held (where stating opinions);

  • Comply with the law of England & Wales and any country from which they are posted.

Submissions must not:

  • Be defamatory, obscene, offensive, hateful or inflammatory;

  • Bully, insult, intimidate or humiliate;

  • Promote sexually explicit material or include child sexual abuse material;

  • Promote violence or discrimination;

  • Infringe any copyright, database right or trade mark;

  • Mislead or deceive;

  • Breach any legal duty owed to a third party (e.g., confidentiality);

  • Promote illegal content or activity;

  • Be in contempt of court;

  • Threaten, abuse, invade privacy, or cause needless anxiety;

  • Harass, upset, embarrass, alarm or annoy another person;

  • Impersonate any person or misrepresent your identity or affiliation;

  • Give the impression the Submission emanates from IVF Choice/BDOPS GROUP LLC if it does not;

  • Contain advertising or promote services/links except as permitted by site functionality.

Breach of these standards

If we consider a breach has occurred, we may take any action we deem appropriate, including:

  • Removal of any Submission;

  • A warning to you;

  • Legal proceedings for reimbursement of costs/damages;

  • Further legal action;

  • Disclosure of information to law enforcement as reasonably necessary or required by law.
    We exclude liability for actions taken in response to breaches.

Rights you grant us to use material you submit

For Submissions intended for publication (e.g., testimonials) or where site functionality indicates sharing, you grant:

  • To us: a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display and perform such content in connection with the website/service and across different media, including to promote the site or service.

  • To other users/partners/advertisers: a worldwide, non-exclusive, royalty-free, transferable licence to use the content only as permitted by site functionality and these terms.

Information provided solely within private survey/lead forms for service provision (e.g., clinic matching) is not published, and is handled per our Privacy Policy. We may anonymise and aggregate responses for analytics and service improvement.

Our responsibility for loss or damage suffered by you

Whether you are a consumer or a business user:

  • We do not exclude or limit liability where it would be unlawful to do so (including liability for death/personal injury caused by our negligence and for fraud/fraudulent misrepresentation).

  • We exclude all implied conditions, warranties, representations or other terms that may apply to our site or content.

  • We will not be liable for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable, arising under or in connection with use of, or inability to use, our site; or use of or reliance on any content.

Which country’s laws apply to any disputes?

  • Consumers: These terms, their subject matter and formation are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are resident in Northern Ireland you may also bring proceedings there, and if resident in Scotland you may bring proceedings there.

  • Businesses: These terms (and any non-contractual disputes or claims) are governed by English law, and we both agree to the exclusive jurisdiction of the courts of England and Wales.
